P-41.1, is constitutionally inapplicable under doctrine of interjurisdictional immunity to aerodrome operated by certain individuals - Whether Act respecting the preservation of agricultural land and agricultural activities, R.S.Q., c. P-41.1, is constitutionally inoperative under doctrine of federal legislative paramountcy, having regard to Aeronautics Act, R.S.C. 1985, c. A-2, and Canadian Aviation Regulations, SOR/96-433.

Lot 51 of Range 1 in the parish of St-Mathieu, in the registration division of Shawinigan, is protected agricultural land. Certain individuals cleared that lot to build a runway 30 metres wide and 1,000 metres long, together with an airplane hangar. The Commission de protection du territoire et des activités agricoles ordered them to cease their non-agricultural activities, restore the land so that it could be used for agricultural purposes, and demolish the airplane hangar. The administrative appeal tribunal and the Court of Québec upheld the order. The Superior Court held that the result was correct in law and dismissed the application for judicial review. The Court of Appeal overturned that decision.
