Forms to be filed with the Supreme Court of Canada

The court forms for Supreme Court of Canada applications for leave to appeal, appeals and motions are found in the Rules of the Supreme Court of Canada. Form Description
Cover (Form 1) A cover page with the name of the parties and the title of the document is required on many documents, including an application for leave to appeal, response and reply to an application for leave to appeal.
Application for leave to appeal (Rule 25) To be used when asking the Supreme Court of Canada to give you leave or permission to appeal a judgment of a lower court.
Response (Rule 27) To be used to respond to an application for leave to appeal before this Court in which you are named as a respondent.
Reply (Rule 28) To be used by applicants who are replying to a response filed under Rule 27.
Public access to information (Rule 23) To be used by all parties in order to alert the Court when there is a publication ban, a sealing order or other confidential information not accessible to the public in the matter being brought before the Court. This form must be filled out in all cases, even if there is no publication ban, sealing order or other confidential information.
Motion to a judge or the Registrar (Rule 47) To be used when asking for an order other than leave to appeal, such as an extension of time.
Motion to a judge for the appointment of counsel (Rule 63.1) To be used when asking the Supreme Court of Canada to appoint a lawyer to represent you as an accused in a criminal matter if section 694.1 of the Criminal Code applies. The requirements that need to be met in these circumstances are found in Rule 63.1 of the Rules of the Supreme Court of Canada.
Motion for extension of time To be used specifically when you have missed a deadline to file a document as set out in the Act or in the Rules. The motion is generally filed at the same time as the document in question.
Affidavit of service (Rule 20) To be used as proof that you have served or delivered a document to all other parties to an application for leave to appeal. An affidavit must be signed before a commissioner of oaths or notary public in your jurisdiction (province or territory). Where permitted by law, an electronically commissioned affidavit can be accepted.
Questionnaire for a self-represented party on an appeal To be used to provide information on the participation of a self-represented litigant on an appeal only. It is not necessary to file this questionnaire when filing an application for leave to appeal.
